Duplex and dual occupancy Design and Builds are now permissible throughout Sydney’s Inner West, Lower North Shore, Northern Beaches and Eastern suburbs on all R1 and R2 zoned land.

 

There are some exceptions to the rule such as bush fire and flood prone land, heritage items, Transport Orientated Development Areas, and land in an ANEF contour of 20 or greater contour (aircraft noise).

 

Generally, duplex and dual occupancy approvals can be obtained via CDC (complying development certificates) using a certifier where dual occupancies or duplexes have been zoned for. Not all sites are zoned for duplexes or dual occupancies. Where it is not zoned for but in R1 or R2 zoned land, consent can be sought for a duplex or dual occupancy via a development application lodged with Council, which they may not refuse based on SEPP (Exempt and Complying Development Codes) Part 3B Low Rise Housing Diversity Code. These development standards are yet to be adopted by the State of NSW but will be adopted later this year. In the mean-time, applications will be assessed against Council controls.

 

The rules for minimum land sizes, site frontages (12 or 15 metres depending), landscape areas, set-backs etc are found in the SEPP unless covered by the specific Council’s Local Environment Plan.

 

The land for duplexes and dual occupancies is sub-divisible.
